Terms of Service

These Terms of Service apply to purchases from and use of UMBER DNA° and our website. By accessing our website, placing an order, submitting customization materials, or purchasing a product, you agree to these Terms.

Orders & Payment

Full payment is required before UMBER DNA° begins design or production unless otherwise agreed in writing.

Customers are responsible for providing accurate order information, including sizes, names, numbers, colors, photographs, shipping information, and customization details.

UMBER DNA° reserves the right to contact a customer for clarification when information necessary to complete an order is missing or unclear.

Custom & Personalized Products

UMBER DNA° specializes in made-to-order and personalized apparel.

Customers are responsible for reviewing all information submitted with their order. This includes spelling, names, numbers, sizing, colors, design selections, placement requests, and other customization details.

Because customized products are made specifically for each customer, they are subject to our Refund Policy.

Design Proof & Approval

When applicable, UMBER DNA° will provide a design proof before production.

Customers are responsible for carefully reviewing the proof, including names, numbers, spelling, colors, photographs, placement, and other design details.

Production will not begin until final approval is received.

Once a design has been approved and production has begun, additional changes may not be possible and may result in an additional charge.

Customer delays in approving a proof may extend the estimated turnaround time.

Production & Turnaround

Most custom orders are completed within approximately 5–7 business days after final design approval, unless otherwise stated or agreed upon.

Production time and shipping/transit time are separate.

Turnaround estimates are not guaranteed delivery dates. Delays may occasionally occur due to product availability, supplier delays, shipping carriers, unusually large orders, or circumstances outside UMBER DNA°'s reasonable control.

Customer-Submitted Photos, Logos & Artwork

Customers may submit photographs, logos, graphics, artwork, names, team information, or other materials for customization.

By submitting material to UMBER DNA°, you confirm that you own the material or have sufficient permission or authorization to use it for the requested product.

Customers are responsible for obtaining any permissions that may be required for copyrighted, trademarked, licensed, school, team, organization, business, or other third-party materials they request UMBER DNA° to use.

UMBER DNA° reserves the right to decline a customization request when we believe the requested use may violate another party's rights or otherwise be inappropriate for production.

UMBER DNA° does not obtain ownership of a customer's original photograph or other customer-owned material merely because it is submitted for customization.

Intellectual Property & UMBER DNA° Designs

Unless expressly agreed otherwise in writing, original designs, artwork, graphics, layouts, design concepts, product imagery, photographs, branding, logos, website content, and other original creative materials created and owned by UMBER DNA° remain the intellectual property of UMBER DNA°.

Purchasing a customized product does not constitute the purchase or transfer of the underlying artwork or intellectual-property rights.

This applies to both existing UMBER DNA° designs and original custom designs created specifically in response to a customer's order.

Personalizing a design with a customer's photograph, name, number, team information, colors, wording, or other requested elements does not transfer ownership of the underlying UMBER DNA° artwork.

Unless UMBER DNA° expressly provides written permission, UMBER DNA° designs may not be copied, reproduced, traced, recreated, digitized, modified for reproduction, distributed, sold, commercially exploited, or used to manufacture additional products.

Customers may not provide UMBER DNA° artwork or design files to another printer, apparel company, designer, manufacturer, print-on-demand provider, or other third party for reproduction without prior written permission from UMBER DNA°.

If UMBER DNA° agrees to transfer ownership, provide an exclusive license, or grant additional commercial rights to a particular design, those rights must be separately agreed upon in writing. Additional design or licensing fees may apply.

Marketing Use of Custom Work

Submitting an order does not automatically grant UMBER DNA° permission to use a customer's photograph or customized product for marketing.

Customers may separately choose whether to authorize UMBER DNA° to feature their submitted design materials, design proof, production process, and/or finished customized product for promotional purposes.

When permission is provided, UMBER DNA° may display the authorized content on our website, social media, portfolio, advertisements, or other marketing materials.

Marketing permission is optional and does not affect the customer's order, pricing, or service.

When the content depicts a minor, the person granting permission confirms that they are the minor's parent or legal guardian, or otherwise have appropriate authority to grant such permission.

Colors, Placement & Product Appearance

We make reasonable efforts to accurately represent designs and products.

Colors may appear somewhat different between digital screens and finished printed products. Minor variations in print placement, garment color, dimensions, or appearance may also occur as part of the production process.

These normal production variations are not considered defects.

Sizing

Customers are responsible for selecting the appropriate garment size before ordering.

Because customized products are made specifically for the customer, incorrect size selection by the customer generally does not qualify for a return or exchange.

Cancellations

If you need to cancel an order, contact UMBER DNA° as soon as possible.

Once design work, material purchasing, printing, or other production has begun, cancellation or a full refund may no longer be available.

UMBER DNA° Errors & Defective Products

If UMBER DNA° produces an item that does not match the customer's approved design or confirmed order details because of an error on our part, we will work with the customer to correct or remake the affected item when appropriate.

Damaged or defective products should be reported in accordance with our Refund Policy.

Shipping & Local Delivery

Customers are responsible for providing accurate shipping and delivery information.

Shipping transit times begin after production is complete.

Local delivery, when available, is subject to the delivery area, minimum-order requirements, applicable delivery fee, and individual delivery arrangements presented at checkout or communicated after ordering.

UMBER DNA° is not responsible for delays caused by shipping carriers or circumstances outside our reasonable control.

Website Use

The UMBER DNA° website and its content are provided for personal shopping and informational purposes.

Users may not misuse the website, attempt unauthorized access, interfere with its operation, scrape or systematically extract proprietary content, or use UMBER DNA° content for unauthorized commercial purposes.

Privacy

Use of personal information, uploaded photographs, customization information, and other customer information is governed by our Privacy Policy.

Changes to These Terms

UMBER DNA° may update these Terms of Service from time to time to reflect changes in our products, services, business practices, or legal requirements.

The version posted on our website at the time of an order will generally apply to that transaction.
